Cycle Rider Safety Training Act Protection
Lawsuit

Springfield Nov 15, 2006 - ABATE attorneys received a fax from Judge Zappa of an Order he entered today DENYING the State's motion to dismiss our complaint regarding the Cycle Rider Safety Training Fund.

It is encouraging to find that this judge respects the explicit language in the Cycle Rider Safety Training Act that places the CRST Fund in trust outside the state treasury.

The next step is discovery (requests to admit and produce, interrogatories, and depositions). Then, we go to trial for the permanent injunction.

 

The Illinois General Assembly
Fall Veto Session, November 14 to 16 and November 28 to 30.

This is the time set aside to attempt to overturn the governor's veto of bills and house keeping. ABATE of Illinois does not have any legislation pending. Please keep vigilant to OnDgo incase there are changes.

 

Motorcycle Advisory Council Appointed

Acting Department of Transportation Secretary, Maria Cino, announced the roster of individuals appointed to the Motorcycle Advisory Council to the Federal Highway Administrator (MAC-FHWA)

 

Secretary Of Transportation Nominated
September 5, 2006

The Motorcycle Riders Foundation (MRF) reported on Tuesday, September 5th, President Bush announced Mary Peters, a former Federal Highway administrator, as his choice to succeed Norman Mineta as Secretary of Transportation.

"Mrs. Peters has been extremely supportive of motorcyclists evidenced by her advocation of the Motorcycle Advisory council included in the last highway bill," said Jeff Hennie, Vice President of Government Relations for the Motorcycle Riders Foundation. He added, "The MRF looks forward to a productive working relationship with Mary Peters in her new role as a cabinet level advisor to President Bush."

 

EPA compliant engine packages
Individuals and small volume motorcycle builders and manufacturers will be able to use these engines to build EPA compliant motorcycles. By using these approved engine packages an individual may build and ride as many custom motorcycles as they want, as long as the engine package is not altered in a way that will increase exhaust emissions for any pollutant.

The litigation was sparked when Blagojevich was caught draining over $350,000 from the Cycle Rider Safety Training Fund and the Recreational Trails Fund. Each of these funds is supported by surcharges on motorcycle license and registration fees. These two special funds were set up to promote motorcycle safety and environmental stewardship in off-road areas. In response to Blagojevich's actions, ABATE successfully sought a temporary restraining order against the governor that barred his tapping into the motorcycle-related funds.

Right to Repair Act
May 27, 2006

On May 16, you were asked by ABATE and the MRF to call your congressman about HR2048 the right to repair. People are asking what is going on? Well you must remember this is the Federal Government and they go at there own speed. Illinois legislature is slow but the Fed is slower.

After talking with Jeff Henie from the MRF The hearing was held by the House Energy and Commerce Committee, Subcommittee on Commerce, Trade and Consumer Protection it went well with Congressman Jan Schakowsky as the only Illinois congressman testifying on our behalf.

It now goes to the House Energy and Commerce Committee, unless they send it to another committee. No hearing date is scheduled we will inform you when it is scheduled.
