I understand that you are getting a lot of
questions about a couple of bills
that deal with plates and such.
The
Illinois constitution, under Article 6 Section 8 (d) states:
"A bill
expressly amending a law shall set forth completely the sections
amended."
These bills amend a section of law that deals with fund
sweeps. Since they
amend that section of law, the current law, that allows
the stealing of the
money for general revenue purposes and the basis for our
lawsuit, is
modified. On line 13 of the amendment the word or is omitted.
Therefore
pursuant to the Constitution, the whole section must be reprinted.
Nothing
else is being changed.
When others read a bill, they need to
look at the underscored language which
is new, and that which is “struck
through” which is being removed. Anything
else is simply a restatement of
the current law.
While the governor is proposing fund sweeps again, and
it looks like once
again, our "friend" is going to raid the Cycle Rider
fund, nothing else here
is being changed.

The problem is
when you copy something with strikes through it or underline
add ins it
doesn't copy them. Todd's message was all underlined, none of it
came
through.
These bills are being amended to exempt them from the Governor
sweep fund.
ABATE of Illinois has tried this in the past. The
Governor VETOS the bill
and we over ride the VETO but the money is already
swept.
That is why ABATE of Illinois choose to file a
lawsuit. That is what
George Tonka has been working on for over a
year.
Leggs sent an Email out to all eboard members regarding a NHTSA
lobbying for
a Nation wide Helmet law. This is from the MRF not ABATE
of Illinois.
ABATE of Illinois will be giving you it's Strategy on how
to handle this.
Federally it is ILLEGAL for NHTSA to LOBBY states
regarding helmet laws. We
have people leaving tomorrow for
Washington.
